1. INTRODUCTION AND BINDING NATURE
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”, “you”, “your”) and Adventure HQ L.L.C. (“AHQ”, “we”, “us”, “our”) governing your access to and use of our website, stores, and services, including the rental and/or purchase of outdoor and adventure equipment (“Items”).
By accessing our website, placing an order, or collecting any Items, you expressly acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any provision herein, you must immediately discontinue use of our services.
2. SERVICE DESCRIPTION
AHQ operates a retail and rental platform for outdoor and adventure equipment. Our services include short-term rental of equipment such as camping gear, accessories, and related products, as well as outright sale of such Items.
All services are provided strictly subject to availability, operational feasibility, and compliance with these Terms. AHQ reserves the absolute right, at its sole discretion, to refuse, limit, or cancel any order or service without liability, particularly in cases involving operational constraints, suspected fraud, or breach of these Terms.
3. ELIGIBILITY AND CUSTOMER VERIFICATION
Use of AHQ rental services is strictly limited to individuals who are at least eighteen (18) years of age and are either UAE nationals or legally residing in the UAE.
As a condition for any rental transaction, the Customer shall be required to provide a valid Emirates ID and present the original Emirates ID at the time of pickup. AHQ reserves the right to verify identity, request additional documentation, and refuse service where identity cannot be satisfactorily verified.
Further, the Customer must provide a valid credit card for the purpose of security deposit tokenization. Failure to comply with any verification requirement shall entitle AHQ to cancel or refuse the Order without liability.
4. RENTAL MODEL AND STORE OPERATIONS
All rentals under AHQ operate on a strictly store pickup model. Customers are required to collect rented Items from designated AHQ store locations, currently including Times Square Centre, Mirdif City Centre, and Dalma Mall (Abu Dhabi) and such other locations as may be notified.
AHQ does not provide delivery for rental Items unless expressly agreed in writing. Any exception granted shall remain discretionary and subject to additional charges and operational feasibility.
At the time of pickup, Customers must present valid identification, confirm the Order details, and inspect the Items. AHQ reserves the right to withhold release of Items in the event of non-compliance with any requirement.
5. RENTAL PERIOD AND TIME CALCULATION
The minimum rental period shall be one (1) full day (24 hours) unless otherwise specified.
The rental period commences at the time of pickup and ends at the agreed return time. A grace period of one (1) hour may be allowed at AHQ’s discretion; however, any delay beyond such grace period shall result in the automatic application of an additional full day rental charge.
This provision is strictly enforced to ensure operational efficiency and availability for subsequent bookings.
6. PRICING, AVAILABILITY, AND ORDER CONFIRMATION
All prices are displayed in UAE Dirhams (AED) and are subject to change without prior notice. Prices applicable to an Order shall be those displayed at the time of checkout, unless there is a manifest error.
Orders shall be deemed confirmed only upon successful completion of payment and receipt of confirmation from AHQ. Availability of Items is not guaranteed until such confirmation is issued.
AHQ reserves the right to cancel or refuse any Order in cases including, but not limited to, pricing errors, stock unavailability, suspected fraudulent activity, or breach of these Terms.
7. PAYMENTS
All payments must be made online using the payment methods made available at checkout. AHQ does not accept cash payments for rental or purchase transactions.
Where “Tabby” or similar payment options are used, the Customer agrees to comply with the third-party provider’s terms and approval processes. Failure of payment authorization or completion shall result in the Order remaining unconfirmed or being cancelled.
The Customer warrants that they are authorized to use the selected payment method and agrees to indemnify AHQ against any unauthorized usage claims.
8. SECURITY DEPOSIT AND CARD TOKENIZATION
By proceeding with a rental Order, the Customer expressly authorizes AHQ to tokenize their credit card details and to apply charges as necessary in accordance with these Terms.
The security deposit may be used to recover any amounts due from the Customer, including but not limited to damage, loss, late return charges, cleaning fees, and any outstanding balances.
Upon return and inspection of the Items, AHQ shall process the refund of any unused deposit amount within approximately 24 hours. However, actual credit timelines shall depend on the Customer’s bank or payment provider.
9. INSPECTION, ACCEPTANCE, AND RESPONSIBILITY
The Customer is obligated to inspect all Items immediately upon pickup. Any defects, damages, or issues must be reported immediately, accompanied by appropriate photographic or video evidence.
Failure to report within this timeframe shall constitute conclusive acceptance that the Items were received in good condition.
From the time of pickup until return, the Customer assumes full responsibility for the Items, including any damage, loss, or theft.
10. USE OF EQUIPMENT AND RISK ASSUMPTION
The Customer agrees to use all rented Items responsibly, strictly in accordance with their intended purpose and any instructions or guidelines provided.
The Customer acknowledges that outdoor and adventure activities inherently involve risks, including but not limited to physical injury, environmental hazards, and equipment misuse. By renting and using the Items, the Customer voluntarily assumes all such risks.
AHQ shall not be liable for any injury, loss, or damage arising from the use or misuse of the Items, except to the extent required under applicable law.
11. RETURN CONDITIONS
All rented Items must be returned:
- On or before the agreed return time
- In clean condition
- With all original components and accessories
- Without damage beyond normal wear and tear
Failure to meet these conditions shall result in applicable Additional Fees.
12. ADDITIONAL FEES AND CHARGES
AHQ reserves the right to levy additional charges in the following circumstances:
- Late Returns: Full day rental charge per additional day
- Cleaning Fees: AED 50 or first-day rental rate (whichever is lower)
- Damage: Repair costs or full replacement value if irreparable
- Loss or Non-Return: Full retail replacement cost
- Administrative Costs: Including recovery, logistics, and handling
These charges may be deducted from the deposit or charged directly to the Customer’s payment method.
13. CANCELLATION AND RESCHEDULING
Cancellations must be made no later than 9:00 PM (Dubai time) on the day preceding the rental date. Any cancellations beyond this deadline shall incur a 100% charge of the booking value.
Rescheduling requests are subject to availability and must be made prior to the cancellation cutoff. Same-day rescheduling is not permitted.
14. OUTSTANDING PAYMENTS AND SET-OFF RIGHTS
The Customer agrees that any outstanding balance owed to AHQ shall be payable immediately upon demand.
AHQ reserves the right to deduct such amounts from any deposit held or to apply (“set-off”) any payments made by the Customer, including payments for new Orders, against prior outstanding balances.
AHQ may suspend services, block accounts, or cancel Orders until all dues are cleared.
15. FAILURE TO RETURN ITEMS
In the event that any Item is not returned by the agreed time, AHQ shall be entitled, without prejudice to any other rights, to:
- Continue charging daily rental fees
- Charge the full replacement value of the Item
- Recover the Item through third-party agencies
- Initiate legal proceedings
The Customer shall remain liable for all associated costs.
16. FRAUD AND MISUSE
AHQ reserves the right to investigate and take appropriate action against fraudulent transactions, abuse, or misuse of services. This includes account suspension, blacklisting, reporting to authorities, and legal action.
17. LIMITATION OF LIABILITY
To the fullest extent permitted under UAE law, AHQ shall not be liable for any indirect, incidental, or consequential damages.
In any event, AHQ’s total liability shall not exceed the amount paid by the Customer for the relevant Order.
18. DATA PROTECTION AND PRIVACY
AHQ may collect and process personal data, including Emirates ID and payment information, for purposes including identity verification, fraud prevention, and service delivery, in accordance with applicable data protection laws.
19. FORCE MAJEURE
AHQ shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including but not limited to natural disasters, government actions, supply chain disruptions, or emergencies.
20. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai.
21. AMENDMENTS
AHQ reserves the right to amend these Terms at any time. Updated Terms shall take effect upon publication on the website.
